These Terms of Use ("Terms") govern your access to and use of the website roastlab.life (the "Site") operated by RoastLab Inc., a Manitoba corporation with business number BN 844567890MB0001, having its studio at 211 Bannatyne Avenue, Suite 305, Winnipeg, Manitoba R3B 0Y3, Canada ("RoastLab," "we," "us," or "our"). By accessing the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. About RoastLab
RoastLab is a barista education studio teaching espresso, milk texturing, pour-over, and cupping through structured beginner programmes in Winnipeg's Exchange District. We do not operate a restaurant, bakery, food delivery service, coaching franchise, or retail café. We do not sell roasted coffee, green coffee, or brewing equipment to consumers through the Site. Content on the Site is provided for informational and educational purposes related to barista technique and studio programmes.
2. Eligibility
You must be at least eighteen years of age or the age of majority in your jurisdiction to use the Site. By using the Site, you represent that you meet this requirement and that you have authority to enter into these Terms on behalf of yourself or the organisation you represent.
3. Permitted use
You may browse the Site, reference publicly available programme descriptions for internal training planning, and submit contact enquiries through the provided form. You may cite RoastLab lesson outline excerpts in workshop materials provided you include attribution to RoastLab Inc. and a link to the relevant programme page where distributed digitally.
Prohibited uses include:
- Reproducing, scraping, or redistributing Site content for commercial resale without written permission;
- Removing copyright notices, programme badges, or attribution from downloaded materials;
- Attempting to gain unauthorised access to our systems, send.php processing, or studio networks;
- Submitting false, misleading, or fraudulent contact form information;
- Using automated tools to overwhelm Site infrastructure or circumvent the honeypot spam filter;
- Misrepresenting RoastLab content as your own original curriculum or implying endorsement without consent.
4. Intellectual property
All content on the Site — including text, photographs, lesson outlines, cupping sheets, programme cards, layout designs, logos, and the RoastLab name — is owned by RoastLab Inc. or used under licence. Content is protected by Canadian and international copyright, trademark, and other intellectual property laws.
Limited licence: We grant you a non-exclusive, non-transferable licence to view Site content and download materials explicitly offered for client use under contract. This licence does not permit modification, sublicensing, or creation of derivative works except as agreed in a separate training partnership agreement.
5. Education services
Descriptions of programmes and services on the Site are invitations to enquire rather than binding offers. Enrolment, scheduling, and deliverables require separate confirmation. Scope, prerequisites, and session timing are established on a case-by-case basis during studio correspondence.
Technique guidance and sensory descriptors represent instructor consensus at the time of publication. Coffee is an agricultural product subject to natural variation; RoastLab does not guarantee that independently sourced roasts or home equipment will match studio outcomes when water chemistry or grinder burrs differ from our Bannatyne Avenue benches.
6. User submissions
When you submit information through our contact form, you represent that the content is accurate and that you have the right to share it. Practice photos submitted during instructor Q&A must not infringe third-party rights or contain confidential information you are not authorised to disclose.
By submitting content for training partnership review, you grant RoastLab a licence to reference approved material with attribution as agreed in writing. We are not obligated to respond to every submission or accept every partnership proposal.
7. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Programme materials reflect supervised instruction at documented dates using named reference roasts, calibrated water, and specified studio equipment. Results vary with home grinder burrs, machine pressure, ambient temperature, and roast freshness. RoastLab is not responsible for operational decisions made based on Site content alone without enrolled supervision.
Education disclaimer: RoastLab provides barista education for informational and training purposes. We are not a restaurant, bakery, food delivery operator, coaching franchise, or beverage retailer. Nothing on the Site constitutes food safety certification, employment guarantee, or medical guidance. Steam wand and espresso equipment practice carries inherent risks; learners must follow instructor safety briefings during all studio sessions.
External links, if present, are provided for convenience. We do not control third-party sites and are not responsible for their content or privacy practices.
8. Limitation of liability
To the maximum extent permitted by applicable law, RoastLab Inc., its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or reliance on its content, including lost profits, lost data, equipment damage, or business interruption.
Our total aggregate liability for any claim relating to the Site shall not exceed one hundred Canadian dollars (CAD $100) or the amount you paid RoastLab for services in the twelve months preceding the claim, whichever is greater.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable Manitoba or Canadian law.
9. Indemnification
You agree to indemnify and hold harmless RoastLab Inc. from claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of Site content, or infringement of third-party rights through submissions you provide.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and process personal information under PIPEDA. Contact form submissions require explicit consent via the consent_pipeda checkbox as described in that policy.
11. Cookies
We use cookies as described in our Cookie Policy. Consent preferences are stored for six months. By continuing to use the Site after interacting with our cookie banner, you acknowledge our cookie practices as configured by your chosen preferences.
12. Modifications
We may revise these Terms at any time by posting an updated version on the Site with a new effective date. Material changes will be indicated on this page. Your continued use after changes constitutes acceptance. We encourage periodic review of these Terms.
13. Termination
We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or engaged in conduct harmful to RoastLab or other users. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) shall survive.
14. Governing law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Winnipeg, Manitoba, for disputes arising from these Terms or your use of the Site.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
16. Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and RoastLab Inc. regarding use of the Site, superseding prior oral or written understandings on that subject. Separate written contracts govern paid programme enrolment and override conflicting Site descriptions where explicitly stated.
